Workers' Compensation
Injured on the Job? We Fight for Your Benefits.
You got hurt doing your job. Now the insurance company is minimizing your injury, delaying your claim, or denying benefits altogether. We make sure you get what you deserve.
Getting injured at work changes everything. You're in pain, you can't work, bills are piling up — and the insurance company is treating you like a problem to solve, not a person who got hurt.
Workers' compensation is supposed to cover your medical bills and replace your lost wages while you recover. But insurance companies don't make money by paying claims. They make money by denying them, delaying them, and offering settlements that don't come close to covering what you've lost.
Joe Cervantez represents injured workers and fights to make sure they get every benefit they're entitled to. He also works with insurance companies on the defense side, which means he knows exactly how they evaluate claims, what they look for to deny coverage, and how to counter their tactics.
Whether you're dealing with a denied claim, a lowball settlement offer, or an injury your employer won't acknowledge — we're here to fight for you. And we're available 24/7 because injuries don't happen during business hours.
WE HANDLE
Workplace Injuries
Slip and falls, machinery accidents, repetitive stress injuries, back and neck injuries, broken bones, burns — if you got hurt at work, you deserve benefits.
Occupational Diseases
Exposure to chemicals, respiratory conditions, hearing loss, carpal tunnel — diseases caused by your work environment are covered under workers' comp.
Denied Claims
Insurance companies deny claims for any reason they can find. We challenge denials and fight to get your benefits approved.
Delayed Benefits
Waiting weeks or months for approval while bills pile up? We push insurance companies to process claims and pay what you're owed.
Settlement Negotiations
Insurance companies offer lowball settlements hoping you'll take it and go away. We negotiate for the full value of your claim.
Permanent Disability Claims
If your injury leaves you permanently disabled or unable to return to your previous work, you're entitled to additional compensation. We make sure you get it.
Disputed Medical Treatment
Insurance companies deny necessary medical treatment to save money. We fight to get you the care your doctor says you need.
Retaliation & Termination
Fired after filing a workers' comp claim? That's illegal. We protect your rights and hold employers accountable.
WHAT YOU NEED TO KNOW
You're entitled to benefits even if the accident was your fault. Workers' comp is a no-fault system. It doesn't matter if you made a mistake — if you got hurt at work, you're covered.
You don't have to prove your employer did anything wrong. You just have to prove the injury happened at work and you're unable to work because of it.
Your employer can't fire you for filing a claim. Retaliation is illegal. If they terminate you or reduce your hours after you file, we can take action.
The insurance company is not on your side. They represent your employer, not you. Their goal is to pay as little as possible.
COMMON MISTAKES THAT HURT YOUR CLAIM
Not reporting the injury immediately.
Delayed reporting gives the insurance company an excuse to claim the injury didn't happen at work. Report it to your supervisor the same day — even if it seems minor.
Not seeking medical attention right away.
Insurance companies use gaps in treatment to argue you're not really injured. Get medical care immediately and follow your doctor's orders.
Giving a recorded statement to the insurance company.
They'll use your words against you. Don't give statements, don't sign forms, don't settle without talking to an attorney.
Posting on social media.
Insurance companies monitor Facebook, Instagram, TikTok. A photo of you looking active can be used to deny your claim — even if it's misleading.
Accepting the first settlement offer.
The first offer is always low. Don't accept anything without getting legal advice first.
WHAT YOU'RE ENTITLED TO
Medical Benefits
All reasonable and necessary medical treatment related to your injury — doctor visits, surgery, physical therapy, prescriptions, medical equipment.
Temporary Total Disability (TTD)
If you can't work at all while recovering, you receive two-thirds of your average weekly wage.
Temporary Partial Disability (TPD)
If you can work light duty but earn less than before your injury, you receive two-thirds of the wage difference.
Permanent Partial Disability (PPD)
If your injury results in permanent loss of function (lost finger, reduced mobility, chronic pain), you're entitled to additional compensation based on the severity.
Permanent Total Disability (PTD)
If your injury leaves you unable to work at all, you receive ongoing benefits for life.
Vocational Rehabilitation
If you can't return to your previous job, you may be entitled to retraining for new work.
THE PROCESS
Report Your Injury
Tell your supervisor immediately. Get it in writing. Even minor injuries should be documented.
Seek Medical Treatment
Your employer may direct you to a specific doctor. Go. Get treated. Follow all medical advice.
File Your Claim
You have three years from the date of injury to file a workers' comp claim, but waiting hurts your case. File as soon as possible.
Investigation
The insurance company investigates to find reasons to deny your claim. We investigate to prove you deserve benefits.
Negotiation
We negotiate with the insurance company to get you the medical treatment, wage replacement, and settlement you deserve.
Hearing
If the insurance company denies your claim, we take it to the Illinois Workers' Compensation Commission and fight for your benefits.
WHY THE INSURANCE DEFENSE EXPERIENCE MATTERS
Joe represents injured workers — but he also works with insurance companies on defense cases. That means he knows exactly how they evaluate claims, what they look for to deny coverage, and what strategies they use to minimize payouts.
When you're up against an insurance company, that insider knowledge is your advantage.
WHAT TO DO AFTER A WORKPLACE INJURY
Report it immediately. Tell your supervisor the same day, even if the injury seems minor. Delayed reporting can jeopardize your claim.
Get medical attention. Your employer may direct you to a specific provider. Follow their instructions, but also see your own doctor if needed.
Document everything. Take photos, get witness names, keep copies of all incident reports and medical records.
Don't sign anything without legal advice. Insurance companies ask you to sign forms or give recorded statements. Don't do it without talking to an attorney first.
